Divorce

You are able to get a divorce if you have been separated for 12 months, including if you have been separated under the same roof.  You can apply for a divorce jointly (Joint Application) or on your own (Sole Application).

We make the process easy for you.  We will prepare, file your Application for Divorce in the Federal Circuit and Family Court of Australia, arrange for your Application for Divorce to be served on the other party and file the required notification of service in the Court for you.

It is not necessary for you to attend the Court for the hearing for your divorce unless you have children.  We will advise you when your divorce has been granted and provide you with a copy of the Court Order for your divorce.

If you have not settled your property matters prior to your divorce, you need to be aware that a time limit of 12 months from the date of your divorce in which you are able to make an Application to the Court for Property Orders exists.

If you have not settled your property matters within 12 months of the date of your divorce and need to make an Application to the Court for Property Orders it may be possible for you to make an Application out of time.  It is important to seek legal advice in this situation.
